These Terms & Conditions ("Terms") govern your access to and use of the website, mobile applications, and services operated by TheRentalDaddy ("TheRentalDaddy", "we", "us", or "our"), a short-term accommodation booking platform serving hotels, resorts, villas, homestays, and PG/co-living properties across India, with a primary focus on Delhi NCR. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By creating an account, browsing listings, making a booking, or otherwise using any part of the TheRentalDaddy platform, you confirm that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, our Cancellation Policy, and our Refund Policy, each of which is incorporated herein by reference. We may update these Terms from time to time as described in Section 12 below.

2. Eligibility and Account Registration

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to create an account or make a booking on TheRentalDaddy. By using our platform, you represent and warrant that you meet this eligibility requirement.

• You agree to provide accurate, current, and complete information (name, mobile number, email address, and any identity documents requested for check-in) during registration and booking.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us immediately at the contact details below if you suspect any unauthorised use of your account.
• One person may not maintain more than one active account for fraudulent or abusive purposes; we reserve the right to suspend duplicate or suspicious accounts.

3. Booking Process

TheRentalDaddy acts as an intermediary platform connecting guests with hotels, resorts, villas, and PG/co-living property owners and operators ("Hosts" or "Property Partners"). When you make a booking:

• A booking request is confirmed only after successful payment (in full or as a deposit, as specified at checkout) and issuance of a booking confirmation by TheRentalDaddy.
• Room/property availability, tariffs, taxes, and any applicable service charges are displayed at the time of booking and may vary by season, demand, and property.
• You are responsible for verifying booking details — dates, number of guests, room/property type, and any special requests — before confirming payment. TheRentalDaddy is not liable for losses arising from guest-entered errors.
• Certain properties may require a valid government-issued photo identity proof (Aadhaar, Passport, Voter ID, or Driving Licence) at check-in, in compliance with applicable state and local guest-registration regulations. Failure to produce valid ID may result in denied check-in without refund.
• Check-in and check-out times are set by the individual property and displayed on the listing; early check-in or late check-out is subject to availability and may attract additional charges payable directly to the property.

4. User Responsibilities

As a guest booking through TheRentalDaddy, you agree to:

• Use the platform only for lawful, personal, and genuine booking purposes and not for resale, speculative, or fraudulent bookings.
• Comply with the house rules, occupancy limits, and local laws applicable to the property you have booked.
• Treat the property, its staff, other guests, and neighbouring residents with respect; abusive, unlawful, or damaging conduct may result in immediate eviction without refund and liability for damages.
• Bear responsibility for any damage caused to the property or its contents during your stay, which may be recovered directly by the property or through TheRentalDaddy on the property's behalf.
• Not misrepresent your identity, the purpose of your stay, or the number of occupants at the time of booking or check-in.

5. Host / Property Partner Responsibilities

Hotels, resorts, villas, and PG/co-living operators listed on TheRentalDaddy are independent third parties responsible for the accuracy of their listings, the condition and safety of their premises, compliance with applicable licensing, fire-safety, and local municipal regulations, and honouring confirmed bookings. TheRentalDaddy verifies listing information on a reasonable-efforts basis but does not independently inspect every property and is not the owner or operator of any listed property unless expressly stated otherwise.

6. Payment Terms

• All payments are processed in Indian Rupees (INR) through our third-party payment gateway partners using secure, PCI-DSS compliant payment processing.
• Prices displayed include applicable taxes (such as GST) unless stated otherwise; any additional charges levied directly by the property (e.g. security deposit, resort fee) will be disclosed on the listing where applicable.
• TheRentalDaddy does not store your full card, UPI PIN, or net-banking credentials; these are handled directly by our PCI-DSS compliant payment gateway partner.
• In case of a failed transaction where an amount has been debited from your account, any eligible refund will be processed as per our Refund Policy.

7. Prohibited Conduct

You agree not to: (a) use the platform for any unlawful purpose or to violate any applicable Indian law; (b) attempt to circumvent our booking and payment systems to transact directly with a Host to avoid platform fees; (c) upload false reviews, impersonate any person, or misrepresent your affiliation with any entity; (d) scrape, reverse-engineer, or use automated means to extract data from the platform without our written consent; (e) upload malicious code or attempt to interfere with the security or functioning of the platform; or (f) use the platform to harass, threaten, or discriminate against any Host, guest, or staff member.

8. Intellectual Property

All content on the TheRentalDaddy platform, including the TheRentalDaddy name, logo, website design, text, graphics, and software, is owned by or licensed to TheRentalDaddy and is protected under applicable Indian copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission, except for personal, non-commercial use directly related to making a booking.

9. Limitation of Liability

TheRentalDaddy acts as a booking intermediary and, to the maximum extent permitted by applicable law, shall not be liable for: (a) the acts, omissions, negligence, or misrepresentations of any Host or property; (b) any injury, loss, or damage suffered during your stay at a listed property; (c) inaccuracies in listing content provided by third-party Hosts; or (d) indirect, incidental, or consequential damages arising from use of the platform. Our aggregate liability for any claim arising from your use of the platform shall not exceed the total booking amount paid by you for the specific booking giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under Indian law, including liability for fraud or wilful misconduct.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to Section 11 below, the courts at Delhi, India shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or your use of the platform.

11. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or a booking made through TheRentalDaddy, the parties shall first attempt to resolve the matter amicably through our customer support team. If unresolved within 30 days, either party may refer the dispute to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual consent, seated in Delhi, India, and conducted in the English language. This clause does not affect your rights under the Consumer Protection Act, 2019, including your right to approach the appropriate Consumer Disputes Redressal Commission.

12. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our services, legal or regulatory requirements, or business practices. Material changes will be notified through the platform or via email/SMS where feasible. Continued use of TheRentalDaddy after such changes take effect constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.
